Program: Delayed processing times, Writ of Mandamus and other approaches, 2023-24

Seminar ID:  DPT – 0923   September 21, 2023

Introduction:

There are many reasons why the government might take longer than usual. One of them might be because of the high number of applications they are attempting to handle. Unfortunately, if an important key in the application is forgotten, it can be returned in full. In other cases, where information is provided incorrectly, IRCC may request the applicant to resend a corrected document or provide additional information. Either of these cases will cause a delay in the application as the immigration officer will need these errors amended before the application can continue.

In the event of an undue processing delay, and as a last resort, one can request an Order of Mandamus from the Federal Court to compel the IRCC to decide the case. Before doing so, the applicant must exhaust all other options of following up with IRCC after the expected processing time has passed.

Program: Temporary Resident from A to Z, 2023-24

Seminar ID:  TRV – 08 23 August 24, 2023

Introduction:

The TRV is a document issued by a Canadian Immigration Visa Office outside Canada, showing that the holder has satisfied the requirements for admission to Canada as a visitor. TRVs may be for single entry or multiple entry. As a rule, tourists are admitted for six months. Temporary foreign workers and international students are admitted for varying periods, as determined on a case-by-case basis. Extensions may be applied for from within Canada.

It is important to note that possessing a valid TRV does not necessarily mean that the Canadian Port of Entry officer will admit the visitor into Canada. At the Port of Entry, all visitors must demonstrate that the purpose of their visit to Canada is temporary. Officers at the Port of Entry will deny admission to all persons who, in their opinion, do not intend to leave Canada at the expiry of their visitor status.

An LMIA is also essentially a protectionist measure that has been put in place to defend the labour rights of Canadian citizens and permanent residents of Canada from foreign competition.

Program: Crucial Role of Business Plan in Canadian Business Immigration Programs, 2022-23

Seminar ID:  CBP – 1022   October 20, 2022

Introduction:

Business plans are used by entrepreneurs to secure funding for their business ideas or by small business owners looking to refine their business strategy.

A business plan for your client can be an integral part of their visa application, and the way it is presented can make the difference between their visa being approved or disapproved. The visa business plan defines who they are as well as their prospective business for the visa. Every visa business plan is different from the next, based on the purpose of the business.

The business plan generally projects 3-5 years ahead and outlines the route a company intends to take to reach its yearly milestones, including revenue projections. A well-thought-out plan also helps the entrepreneur to step back and think objectively about the key elements of their business venture and informs their decision-making on a regular basis.

A visa refusal means the applicant did not establish eligibility for a visa to the satisfaction of the officer, as is required under IRPA.

The type of Visa refusal will determine whether or not your client is a good candidate for an appeal. An appeal may be a viable option if you believe that the immigration officer made an incorrect decision when they refused the client’s application.

Program: Extension & Restoration Temporary Visas and Post Graduate Work Permit, 2021-22

Seminar ID:    ERT – 1121

Introduction:

Temporary visas allow foreigners to live legally in Canada for a short time. At the end of that period, the legal status expires and they must leave Canada. To stay longer, they must change their current status to stay longer in Canada.

If a visitor, worker, or student loses their status in Canada, they can apply to restore their status. Restoration of status is needed by any individual who allows their temporary permit to expire before submitting a new application but still would like to remain in Canada.

A post-graduation work permit (PGWP) allows students to remain in Canada and work full-time after they complete a certificate, diploma, or degree that is at least 8 months in length. They don’t need a job offer to apply and can work anywhere in Canada in any occupation, even if it’s unrelated to their studies.
